DETERMINING THE ELECTION RESULTS, RE-VOTING AND RE-ELECTION

Under the wise leadership of our esteemed President, our Homeland is widely known around the world as a state whose international prestige is on the rise. At the same time, systematic work for the further democratization of our society is being implemented on a regular basis thus improving our national legal norms and the electoral system.

As we know, as a result of the constitutional reforms with the new and modern norms of democratic principles, the Parliament of our country has switched to a two-chamber system. These democratic, political and legal reforms has also formed a new form of election conduct.

The creation of Halk Maslahaty of Milli Gengesh of Turkmenistan that is  the new chamber of parliament is of great importance in the political life of our country. Preparations for this important political event, which will take place on March 28, 2021, are currently underway.

Now let's get acquainted on how to determine the election results, re-voting and re-election techniques.

Determining the election results. The results of the elections of the members of Halk Maslahaty are determined by the velayat, Ashgabat city election commission.

Following the vote of the members of the Halk Maslahaty, after members of the  velayat and Ashgabat city halk maslhaty has voted in the respective meeting, the velayat and Ashgabat city election commission announces the end of voting and begins counting the votes.

Ahead of the opening of the ballot boxes, the velayat and Ashgabat city election commissions are counting all unused ballots and making them unusable.

In the elections of the members of the Halk Maslahaty, the votes are counted separately for each of the candidates in each velayat and in Ashgabat.

During the counting of votes, the velayat and the Ashgabat city election commission shall determine the total number of voters in the velayat and Ashgabat city, as well as the number of voters who received the election ballot.

Election commission shall determine: the total number of voters who cast their ballots on the basis of ballots in the ballot box, the number of votes cast in favor of each of the candidates; the number of ballots recognized as invalid; the number of ballots which was made not to be used.

Any doubts about the authenticity of the ballots shall be resolved by a vote of velayat and Ashgabat city election commission.

For candidates who is not been on the ballot accordingly or who is not been registered or if more than eight or less of the candidates' names are registered in the ballot or if no record has been made, as well as voting for who have left the election  or if additional surname is written, then that election ballot is considered invalid.

The vote counts will be considered at a meeting of the velayat and Ashgabat city election commission, and the results will be included in the respective protocol. The protocols are signed by the chairman, deputy chairman, secretary and members of the velayat and Ashgabat city election commission, and the protocol is announced by the chairman or his deputy, and then immediately sent to the Central Election Commission.

A copy of the protocol is placed in the voting house for public notice. The candidate or his / her trustee or the observer has the right to obtain a certified copy of the protocol of the velayat and Ashgabat city election commission.

The candidates who received the eight votes in the election of members of the Halk Maslahaty are considered to have been elected.

The Central Election Commission (CEC) will summarize the results no later than five days after the elections based on the protocol of the velayat and Ashgabat city election commissions.

Elections can be declared invalid by the Central Election Commission if there occured violations in the election results during the election process or when counting votes.

The Central Election Commission (CEC) will officially publish the results of the election not later than seven days after the election.

Re-voting. If the number of elected members of the Halk Maslahaty is less than eight then the re-election will be held in the same session of the velayat, Ashgabat city halk maslahaty for the unelected mandate.

The decision to hold a re-election is made by the velayat, the Ashgabat city election commission, and then the velayat, Ashgabat city halk maslahaty announces it to the members and informs the Central Election Commission.

In the case of re-voting, the votes of the voters must be equal to the number of unelected mandates of the Halk maslahaty for the velayat, Ashgabat city.

In the case of re-election the velayat and  Ashgabat city election commission is organizing the immediate release of the ballots.

Re-election. If as a result of voting in the elections of members of the Halk Maslahaty the number of elected members of the Halk Maslahaty is less than eight in the velayat and in Ashgabat city and does not allow the re-election to determine who has been elected, or if the election has been declared invalid, elections will be scheduled within three weeks after the general election.

The re-election of members of the Halk Maslahaty shall be determined by the Halk Maslahaty. The news of the re-election will be brought to the attention for the members of the velayat, Ashgabat city halk maslahaty and the public.

The list of voters in the re-election is compiled by the velayat, Ashgabat city election commission based on the information provided by the velayat, Ashgabat city halk maslahaty. Re-election shall be held in accordance with the Electoral Code of Turkmenistan not later than fifty days after the general election.

The number of votes cast in the re-election must be equal to the number of unelected mandates of the Halk Maslhaty for the velayat, Ashgabat city.

In the re-elections, the Central Election Commission is organizing the release of ballots.
